P. v. Osmin A: Petty Theft conviction with probation violation.  Probation terminated early so client could start his citizenship process sooner!

Jimenez:  Was on probation for a DUI in Ventura County.  Needed to re-apply for a work visa and was trying to get a promotion.  The ultimate goal was to get the case dismissed pursuant to PC 1203.4, but that could not be done until probation was terminated, and she had one more year to go on probation.  I filed a motion to terminate probation early which was granted by the Judge after a hearing on the matter. – MOTION FOR TERMINATION OF PROBATION GRANTED!   (Ventura Court)

– REDUCING FELONY MARIJUANA RELATED CONVICTIONS DOWN TO MISDEMEANORS

P. v. Sean L.:  H&S 11359 and H&S 11360 – Sales of Marijuana and Transportation of Marijuana.  At the time of filing motion to reduce to misdemeanors pursuant to Prop 64, client was still on active formal probation.  Motion Granted! Convictions reduced to misdemeanors for all purposes, formal probation replaced by informal probation.  (Clara Shortridge Foltz Criminal Justice Center, CCB, Los Angeles County)

P. v. Michael D.:  Client had previous drug related felony convictions for H&S 11359 and 11360. There were three separate cases total (each with one conviction). They were older convictions that he already had dismissed (ie. expunged) a few years earlier, but they were still causing complications with international travel. I was successful getting all three convictions reduced to misdemeanors, so they were misdemeanors for all purposes that were dismissed (ie. expunged) as opposed to felonies, which was advantageous for him for several reasons, including international travel. – Felony convictions successfully reduced to misdemeanors! P. v. M. N.:  Client had two separate cases, one with a H&S 11359 conviction, and the other with a H&S 11360 conviction.  Both convictions were felonies that were causing issues with her employment.  I successfully got both convictions reduced to misdemeanors, then got both cases dismissed (ie. expunged) Per PC 1203.4 Felony convictions successfully reduced to  misdemeanors, and subsequently dismissed! REDUCTION OF FELONY CONVICTION TO A MISDEMEANOR PER PC 17(B)

People v. T. Patel:  On felony probation for Felony VC 23152(a) DUI and VC 23152(b) driving with a .08 or higher BAC, with 3 prior DUI’s.  Felony Probation and having a felony conviction on his record was causing employment and travel complications.   I Successfully got his felony conviction reduced to a misdemeanor and his formal probation changed to informal probation.  – Felony successfully reduced to a misdemeanor!

P. v. Leonardo B.  Felony PC 10851(a) taking a car without owner consent (Van Nuys  Court, CA, Los Angeles County) –– Felony successfully reduced to a misdemeanor! (and then petition to dismiss conviction granted).  

P. v. Juan M:  Convicted of a PC 496 receiving stolen property, still on probation.  Was in the country based on temporary protective status and was in jeopardy of losing his status.  Successfully got his felony reduced to a misdemeanor just in time for him to appeal an adverse decision in immigration court.  – Felony successfully reduced to a misdemeanor! Motion to Vacate Judgement – Withdraw of plea and conviction pursuant to PC 1473.5 / PC 1016.5

P. v. M. Espinoza: Client was originally convicted of a felony H&S 11360(a) which was causing her immigration issues.  Initially I was hired to vacate that conviction and withdraw her plea to that charge which I was successful in doing pursuant to PC 1016.5.    The client subsequently pled to an immigration safer plea of PC 32 as a misdemeanor.  After successfully completing that, I was able to get that conviction dismissed pursuant to PC 1203.4.  (Clara Shortridge Foltz Criminal Justice Center, CCB, Los Angeles County)
